Dear members and friends of ipernity,

1) Copyright violations have again become an issue at ipernity. Some may have been innocent oversights, but others were deliberate infringements. Therefore, we feel obliged to address it again. We remind you to strictly observe the corresponding Chapter 6 of our Terms of Use.

2) Copyright compliance is a legal requirement for which each ipernity member is personally responsible. As the legal requirements vary from country to country, it is up to each of you to find out for yourself which regulations apply to you.

3) This is particularly topical for all residents of the European Union, because all states of the European Community have adopted the corresponding European directive EU 2019/790 into national law this year. This means that the copyright regulations have changed in all European countries this summer. Please inform yourself before using or quoting other people's works. Disregard can cost you a lot of money!

4) Please also inform yourself if you want to edit other people's works. There are strict guidelines for this all over the world. Lack of knowledge in this regard does not protect you from legal consequences, which always result in heavy penalties.

5) As the operator of this website, our association is obliged to deal immediately with copyright infringements that are reported to us. We will therefore do this without exception and immediately when we become aware of it. We will delete such material immediately without prior notice to protect you and us as operators from further legal action. We will only contact you if the situation is in doubt.

6) Also, consistent with the policies of other photo and art sharing sites, repeated infringements (three or more) will result in account suspension or deletion since misrepresentation of another’s work as your own is unethical, intellectually dishonest and illegal.

It has the "Ford" emblem and "Ford" is copyrighted. What exactly is copyright violation in relation to posting pictures on Ipernity? I wish it were spelled out exactly. It seems like things like this are left intentionally vague and in so doing, that leaves the door open for people to file nuisance suits because of "supposed" copyright violations.

I am not an expert by any means, but I believe the information here is mostly talking about when people take other people's photos and claim them as their own. This has happened sometimes when people use ipernity like it is a social media site - grabbing an image from somewhere else on the web and uploading it here. Or grabbing an image from our own site and re-posting it on ones own account. Sometimes people do a slight modification to a photo and try to claim it as their own - that also is not okay.

As to your question about a photo of a Ford vehicle, I suggest you do some research online. My first impulse is that that is not a violation of copyright, but again, I am no expert. I'm sure a little research on your part will give you an answer about your specific example.

Because copyright is a complicated business, and because it varies from place to place, there is no way for us to lay out specific guidlines more so than has been done above.

hi, my idea: why not make a watermark in to the pictures, this could be a general "ipernity" mark with a additonally personal created watermark. every photographer could create a personality watermark and if you want to insert it in your picture make a switch for "on" or "off"

there are many people here who add a watermark to their photos. feel free to do so for your photos.

ipernity does not own the copyright on photos uploaded to the website, so I'm not sure an ipernity watermark would be appropriate.

Copyright is, and always has been, a very complicated subject, with some quite significant differences in various nations around the world.

I echo the advice to familiarise oneself with the requirements of one's own country.
Although, I would add - check the French and American rules, as well.
I suggest that if there appears to be a difference, work to the most strict interpretation !
